General Terms and Conditions of Sale – De Muntzoeker BV
The following terms apply to all sales transactions between De Muntzoeker BV and its customers. Unless explicitly agreed in writing and signed by both parties, no deviations from these terms are valid. These terms take precedence over any general or specific terms provided by the customer, even if dated later. De Muntzoeker BV reserves the right to amend these terms at any time for future transactions, without prior notice or compensation.
De Muntzoeker BV is located at Mgr. Waffelaertlaan 2a/8, 8370 Blankenberge, Belgium, and is registered under VAT number BE1009.583.027.
Customers may place orders online or in-store. When choosing in-store pickup, ordered products – depending on availability – will be ready within a few days. If the customer fails to collect the order within one month after two written reminders, De Muntzoeker BV reserves the right to cancel the order or consider the agreement terminated.
Online orders are delivered after payment to the address provided in Belgium, the Netherlands, Luxembourg or France. In the event of force majeure or circumstances beyond the company’s control, delivery may be delayed. If purchase prices or taxes change during this time, the sale price may be adjusted accordingly. All listed prices include VAT unless stated otherwise. Delivery fees or optional services are clearly indicated separately. Payment is always made in advance using the available online payment methods. Cash payment upon collection or delivery is not accepted.
Shipping is handled by external courier partners. If the customer is not available during delivery, a notification will be left to collect the parcel at a nearby pickup point. Any costs for re-delivery are borne by the customer. Delivery times are indicative and not binding; delays do not entitle the customer to cancel or claim compensation.
Ownership of the goods transfers only after full payment has been received. Until that time, the goods remain the property of De Muntzoeker BV. The customer bears the risk of loss, theft, or damage from the moment of delivery or pickup and agrees to identify and safeguard the goods as the property of De Muntzoeker BV.
Private consumers have the right to withdraw from the purchase within 14 calendar days after receipt, without justification. This withdrawal must be submitted in writing, preferably by registered mail. Only unused and undamaged products in their original packaging will be accepted. The customer bears all costs and risks related to the return shipment. Products excluded from the right of withdrawal are clearly mentioned on the product page.
In the case of payment issues or concerns about a customer’s solvency, De Muntzoeker BV reserves the right to suspend its obligations or terminate the agreement immediately. If payment is not received within seven days of the due date, the agreement is considered legally dissolved without the need for formal notice.
A standard warranty of 12 months from the invoice date applies to most products. For items such as search coils or underwater detectors, a one-year warranty also applies. This warranty covers only manufacturing or material defects. The original invoice or purchase receipt must be presented as proof. Damage due to misuse, normal wear and tear, external factors, or unauthorized repairs is not covered. Nor does the warranty cover damage from force majeure, fire, natural disasters, or misconfigured use. De Muntzoeker BV is not liable for lost data, missing accessories, or any inconvenience caused by unrecoverable faults.
By placing an online order, the customer acknowledges the inherent risks of electronic communication. De Muntzoeker BV is not responsible for damage or loss resulting from outages, viruses, or data loss. Digital communication is considered legally valid.
VAT refunds for non-EU residents or diplomatic purchases are processed via specialized third-party providers. The customer accepts the terms and procedures of these service partners.
Should any provision of these terms be deemed invalid, all remaining clauses remain fully enforceable. The parties agree to replace the invalid clause with a provision that best reflects the original intent. All agreements are governed by Belgian law, and any disputes fall under the exclusive jurisdiction of the courts of Brugge.
